1.1

The contract will become effective as from the date when the client's reservation is confirmed in writing by Trade Now No. 40cc Reg : 1999/009164/23, t/a Action Travel, Phalaborwa Mall, Suite 4, Phalaborwa, South Africa, after receiving the deposit referred to in 2.1.

1.2

The contract is subject to South African Law.

1.3

The client, by signing the reservation form (or accepting in writing a written offer from Action Travel), accepts all the terms and conditions of the agreement as set out hereunder.

1.4

Action Travel reserves the right of participation in the tours offered. Furthermore Action Travel reserves the right, in the event of any participant causing annoyance, disturbance or damage, or acting in such manner as to be detrimental to the good order of the tour, to require such participant forthwith to leave the tour. In such a case refunds (if any) will only be made at Action Travel's sole discretion.

1.5

Action Travel reserves the right, in the event of a tour not receiving sufficient support, either to cancel the tour or to raise the price accordingly. In this second option, clients not willing to pay the increased price may cancel their participation in the tour and have their deposit refunded in full.

PAYMENT

2.1

A 50% deposit on the full contract price is normally required to secure the services offered.

2.2

Final payment is due 30 days prior to commencement of services offered.

PRICE VARIATIONS

3.1

The contract price is based on exchange rates, air fares, hotel prices and other relevant costs applicable on the date of the booking. In the event of there being any increase in any one or more of the aforementioned costs before the departure date, such variations shall be for the account of the client.

CANCELLATIONS

4.1

Any cancellation of a confirmed booking by a client or his agent must be done in writing.

4.2

A 50% cancellation fee will be applicable on the full contract price if the cancellation is received 14 days prior to commencement of services. If cancellation is received 14 days or less prior to commencement of services, Action Travel will determine the cancellation fee after assessing expenses. Our decision on this regard is final.

4.3

Action Travel may at its discretion and at any time cancel any service being rendered impossible, illegal or inadvisable (due to adverse weather conditions, strikes, security reasons or any other reason beyond its control) without any indemnity or obligation except for the return of the money not yet utilized. In the event of Action Travel cancelling the Tour before the scheduled departure date, the full amount paid by the client on account of the contract price will be refunded to him.

RESPONSIBILITY AND LIABILITY

5.1

The services are booked and all arrangements are made subject to the express condition that Action Travel, its employees and its agents shall not be responsible for (and shall be exempt from) all liabilities in respect to any loss, damage, injury, accident, delay or inconvenience to any person or his luggage or their personal property.

5.2

In issuing or obtaining the issue of any ticket or coupon, or making any arrangements for transport, accommodation or provision of food, Action Travel acts as agent only and shall not in any way be liable as principal.

CLIENT'S OBLIGATIONS

6.1

The client shall have valid travel and health documentation, be reasonably physically fit to undertake the chosen tour and be punctual for the departure of all transport for the duration of the tour.

INSURANCE

7.1

Action Travel does not provide any kind of insurance cover for cancellations, medical expenses and loss and/or damage to property or for any other reason.

LUGGAGE

8.1

Each client is allowed only one soft bag weighing not more than 15 Kg plus hand luggage.

ITINERARY

9.1

Action Travel reserves the right to amend its itineraries, modes of transport and accommodation should events require it.

JURISDICTION

10.1

In the event of litigation, the Phalaborwa Magistrate's Court will have full jurisdiction.
